The WVL ensures that the contents of this website are as up-to-date and accurate as possible, and only posts official winning numbers. In case of any discrepancy between the numbers posted on this site and the official winning numbers, the prevailing numbers will be those deemed official by both the Director of the WVL and the independent certified public accounting firm that witnesses the drawings and certifies the validity of winning numbers for entry into the WVL’s central gaming system.

Our Internet Service Provider (“ISP”) automatically captures the following information during each visit to this website: your domain name, the date and time of your access, the pages you visited, the internet address and name of the page that referred you to our website, your current network internet address (IP address), the brand of browser and version used, and the operating system you are using. The West Virginia Lottery app also collects location information to provide offers by sending push notifications when you are close to local retailers or landmarks used for promotional purposes. The location information is collected when the app is in use or in the background.

How the Information is Used

Typically, the information automatically collected and voluntarily submitted is used to provide website visitors with a more personalized experience and to present them with information most pertinent to their specific needs. Player Compliance and Risk Requirements

A WVL iPlay account will be deemed dormant if there is no player-initiated activity for 16 months. Account closures and balance refunds will adhere to the Uniform Unclaimed Property Act of West Virginia, as outlined in W.Va. Code 36-8-1 et seq.

Acceptance of Terms

BY USING THIS WEBSITE OR MOBILE APP, YOU AGREE TO THE FOLLOWING TERMS GOVERNING YOUR WVL IPLAY ACCOUNT.

WVL iPlay Account

A WVL iPlay Account offers various information, activities, promotions, and services related to the WVL. Account members are automatically enrolled in the PlayOn® program, which allows members to collect points ("Points"). Members may use their Points to participate in drawings and other promotional offers provided by the WVL. WVL iPlay Accounts and any activities associated with them are subject to restrictions and void where prohibited by law.

Eligibility and Participation

Participation is open to individuals who are at least eighteen (18) years of age or older. WVL iPlay Accounts are provided to individuals only; corporations, associations, or any groups may not participate. Employees of the WVL and WVL contractors/vendors are prohibited from participating in any WVL iPlay Account promotions and offerings.

Account Creation

To create a WVL iPlay Account, you must complete the required registration fields and submit a legitimate, working email address that is registered in your name and a password. You must also confirm your account by completing the confirmation process as required via our confirmation email.

Account Use

You may utilize no more than one active WVL iPlay Account. Utilizing more than one active account may subject you to disqualification from any WVL promotions. The WVL reserves the right, without warning, to terminate the membership of any individual who establishes more than one active account. A WVL iPlay Account will be deemed inactive if there has been no activity associated with it for the past ninety (90) calendar days.

Responsibility

You are solely responsible for all activity on your WVL iPlay Account and for the security of your computer system/mobile devices. You are also responsible for ensuring that the contact information you provide is current and valid. Failure to keep such information updated may result in the forfeiture of prizes.

Communication

By participating in a WVL iPlay Account, you acknowledge and accept that the WVL may send you emails with information relevant to WVL iPlay Account users. To discontinue receiving such emails, you must opt out by requesting to deactivate your account; however, you will no longer have access to members-only areas of the WVL website or mobile app, and any Points accrued to date will be forfeited.

Taxes

You are responsible for the payment of any and all applicable taxes and other state withholdings resulting from your participation in any WVL iPlay Account activities and/or promotions.

Content and Privacy

The WVL is not responsible for information you choose to communicate to other users on the WVL website or mobile app, or for the actions of other participants. Once you post or send any content to the WVL website or mobile app, you expressly grant the WVL the complete and irrevocable right to quote, re-post, use, reproduce, modify, distribute, transmit, broadcast, and otherwise communicate, and publicly display and perform the content in any form, anywhere, with or without attribution to your identity, and without any notice or compensation to you of any kind. All information collected on this website or mobile app may be public record and may be subject to inspection and copying by members of the public unless an exemption or other protection in the law exists.

Intellectual Property

Some of the content available on the WVL website and mobile app is owned by the WVL or other third parties and is protected by copyrights, trademarks, and other intellectual property rights. The WVL website and mobile app may include hyperlinks to websites operated by parties other than the WVL. The WVL does not control such websites and is not responsible for their content, privacy policies, or for the collection, use, or disclosure of any information those sites may collect.

YOU ACKNOWLEDGE AND AGREE THAT THE WVL, THE WEST VIRGINIA LOTTERY COMMISSION, AND THE STATE OF WEST VIRGINIA ( COLLECTIVELY THE “RELEASED PARTIES”) ARE NOT LIABLE FOR ANY ACT OR FAILURE TO ACT BY IT OR ANY OTHER PERSON REGARDING CONDUCT, COMMUNICATION, OR CONTENT ON THE WVL WEBSITE AND/OR MOBILE APP. IN NO CASE SHALL THE “STATE” BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE WVL WEBSITE AND/OR MOBILE APP, THE USE OF THE INTERNET, OR ANY OTHER CLAIM RELATED TO YOUR USE OF THE WVL WEBSITE AND/OR MOBILE APP.
